洗面奶分男女搞差价?法学大学生又出手了!结局是……

两款洗面奶成分、功效、含量基本相同,却存在67元的差价?女性消费者的产品价格远高于男款这一“粉红税”现象引起了华东政法大学和山东大学5名学生的注意。他们组成“粉红税不队”起诉了欧莱雅公司。近日,这一事件的进展引发关注。

A group of five students from East China University of Political Science and Law and Shandong University recently discovered a pricing discrepancy between two facial cleansers. Despite having nearly identical ingredients, efficacy, and volume, the women's product was priced 67 yuan higher than the men's counterpart. This led them to file a lawsuit against L'Oréal.

据上海法治报报道,去年1月14日,张同学在网店以149元购买了女性专用的“欧莱雅复颜洗面奶”。付完款后,她在店铺推荐页面看到“欧莱雅男士水能保湿氨基酸洗面奶”,价格为82元,净含量为180毫升。每100毫升售价差值高达73.6元。两款洗面奶都主打氨基酸温和性与保湿,但价格却相差一倍。

On January 14 last year, a student surnamed Zhang purchased the "L'Oréal Revitalift Cream Facial Cleanser" for 149 yuan from an online store. After completing the purchase, she noticed the "L'Oréal Men Expert Hydra Energetic Extreme Cleanser" priced at 82 yuan with a net volume of 180 milliliters on the store's recommendation page. The price difference per 100 milliliters was as high as 73.6 yuan. Both cleansers claimed to be gentle and moisturizing, yet the price gap was significant.

“我本以为只是男士女士洁面用品成分含量不同导致价格差异,咨询客服索要两款产品的成分表后,却发现两款产品成分与主打功效相差无几。”同学们对比还发现,“单从包装成本而言也不应存在太大的差价”,且“女款洁面产品的详情页宣传却有更多的功效。”

Initially, Zhang thought the price difference was due to varying ingredient concentrations. However, after requesting the ingredient list from customer service, she discovered that the two products had nearly identical compositions and claimed effects. Further comparison revealed that there shouldn't be a significant difference in packaging costs either, and yet the women's cleanser had more detailed promotional information on its product page.

在网上搜集相关资料得知“粉红税”的概念,张同学表示,女性消费者在部分消费领域处于劣势地位是不可置否的事实,无论是护肤美妆或是电子产品,类似的物品标上“女性专用”后价格总是偏高。为此她与其他几位同学组成“粉红税不队”,认为欧莱雅公司的这种行为涉嫌价格歧视,没有依法保障男女消费者享有公平交易的权利,于是向法院提起诉讼,要求全额退款。

After researching online, Zhang learned about the concept of the "Pink Tax". She stated that women consumers are often at a disadvantage in certain consumption areas, whether it be skincare and beauty products or electronics. Items labeled "for women" tend to be priced higher. Therefore, she and several other students formed the "Pink Tax Denial Team”, believing that L'Oréal's actions amounted to price discrimination, failing to legally safeguard the rights of both men and women consumers to fair trade. They filed a lawsuit against the company, seeking a full refund.

立案后,该公司表示愿意全额退款,但要求同学们签署承诺函,承诺不会在社交网络平台发布或向第三方(包括媒体等)陈述与本案有关的一切信息及事项。

Following the filing, the company expressed willingness to refund the full amount but requested the students to sign a commitment letter, promising not to post or disclose any information related to the case on social media platforms or to third parties, including the media.

考虑到承诺函部分内容不利于后续维权,同学们拒绝了这一要求。近日,同学们在法院的调解下撤诉,欧莱雅退还了购买洗面奶的费用。诉讼虽然告一段落,但维权还未终止。为让更多消费者认识到“粉红税”存在的价格歧视,同学们在多个社交平台发起了“为什么粉红要贵这么多”的话题,解释“粉红税”,并给予网友相关的维权建议。

Considering that some contents of the commitment letter were unfavorable for future rights protection, the students refused this request. Recently, under the mediation of the court, the students withdrew the lawsuit, and L'Oréal refunded the cost of the purchased facial cleansers. While the lawsuit has come to an end, the fight for consumer rights is far from over. In order to raise awareness of the price discrimination represented by the "Pink Tax", the students have initiated the topic "Why should pink be so expensive?" on various social platforms, explaining the concept and providing related advice on consumer rights.
